What Is IR35?

First introduced in 1999 in the UK, IR35 is a tax law. It is more formally known as the Intermediaries Legislation and came into force in April 2000 as part of the Finance Act. The income tax element of the Intermediaries Legislation has subsequently been integrated into the Income Tax (Earnings and Pensions) Act 2003 (ITEPA 2003), and the element concerning National Insurance Contributions (NICs) into the Social Security Contributions (Intermediaries) Regulations 2000.

IR35 was originally introduced to tackle the perceived problem of disguised employment. This is where workers are engaged through a third party, rather than on an employment contract to fulfil a role for the end client. This can save the end client money as it means that they are not responsible for paying Employers’ NICs for these workers, and it also means they do not have to offer any employment rights or benefits.

IR35 is intended to ensure that any individual who, but for the supply of their services through a PSC (treated, for tax purposes, as an ‘intermediary’) would otherwise be regarded as an employee of the end-client, is subject to tax and NI in the same way as a PAYE employee. 

To date, the determination of whether the individual is operating inside or outside of IR35 has been the responsibility of the PSC itself against some key principles set out in case law of control, substitution and mutuality of obligation. In cases where HMRC and PSC are in disagreement about the determination the tax tribunals/courts decide the position. 


  

What's changing with ir35?

​The application of IR35 in practice has failed to crackdown on this disguised employment and they consider many Limited Company owners continue to operate outside the rules. In response to this avoidance new 'off-payroll' rules were implemented in the public sector in April 2017 which mean:

For the first time, the engager of the contractor, i.e. the end-client is responsible for determining the IR35 status.  

Where the contractor is deemed to be 'inside' IR35, then the client or the employment intermediary (through which the contractor is engaged if there is one) must apply statutory deductions i.e. tax and NIC from the contractor’s pay and also pay Employer’s NIC as if the contractor were a traditional employee of the client.

From April 2020, these changes will be rolled out to the private sector with a slight concession in that small businesses will be exempt.  Click here to see the latest published information from HMRC.

HMRC has developed a simple tool for businesses to assess IR35 status, which has come in for much criticism since its initial launch. For their part, HMRC has promised the shortcomings of the CEST tool will be addressed in time for implementation in the private sector, thereby simplifying the determination of the status of the contractor for the end client.

Title: Test Engineer Contract Position based at: JLR Plants and Test Site in Nuneaton Position Description: The Diagnosis Team is a centralised activity to define customer warranty problems in a way that resolving teams can understand and act fast. The information gained from a data defined input to our team is used to generate deeper investigation cross functionally and throughout the world as necessary. The team also operate a Diagnosis Centre comprising its own workshop and office based at Nuneaton where they can replicate failures and test parts working collaboratively with suppliers and engineers. Inspecting, testing and reporting on failed/fatigued components returned from Warranty. Generate and update test plans to diagnose components/ system faults and to replicate the failure mode identified in warranty. Evaluation of engineering drawings, specifications, test methods, DFMEA, Control Plan. Execution of test plans: utilizing vehicles, modules and simulators being able to evaluate the results of the tests. A test track and workshop facilities are part of site where the team is based. instrumenting and using data acquisition methods on whole vehicles and/or vehicle components. Verification of correct diagnostic tool operation and acceptance testing of the diagnostic tools. Processing test data, generating reports and presenting results to relevant engineering personnel. Lead projects creation up to Standard Problem Definition (D2 Step in 8D Process) using Problem Solving Techniques. Job Title: Buyer Location: Stafford A leading off highways organisation has an exciting opportunity for a Buyer to join the Global Supply Network Division (formerly Global Purchasing). This will be on a contract basis with a generous hourly rate. You will be responsible for managing procurement activity for the Large Power System Division (LPSD) at our Stafford Engine manufacturing facility. Your role will involve delivering procurement excellence and integration between Global Supply Network Division (GSND) and the facility. As a Buyer you will provide purchasing solutions expertise and deliver a lean, responsive and resilient material and services flow for the facility from source to dock. The role will demonstrate leadership in implementing cost reduction projects and inventory and quality improvement; as well as responsibility for soundness of business proposals and risk assessment. Job Duties/Responsibilities may include, but are not limited to: Responsible and accountable for the implementation of a local sourcing strategy Managing policies, agreements, special purchasing programs; and supporting specific Product line(s) NPI programs Provide leadership for cost reduction, sourcing, logistics and resource management. Lead continuous improvement initiatives and new product introduction activities within Purchasing Liaison with corresponding Category buyers. Required Qualifications: Degree educated or equivalent experience within a Purchasing role. Previous experience in managing a supplier base.
