Onshore Employment Intermediaries: False Self-Employment Legislation

As expected, an announcement from HMRC yesterday confirmed that the Onshore Employment Intermediaries: False Self-Employment Legislation is likely to become effective as of the 4th April 2014.

Following the confirmation of the full legislation it would appear clear to us that the legislation is focussed toward those individuals operating on a sole trader basis and who are being paid gross of any taxes or NICs. Although the legislation is still subject to final guidance for employers, we are reasonably confident that our contractors that operate through their own Limited Companies will not be impacted by the legislation.

For our contractors employed by an Umbrella organisation, again we are confident that the legislation will have no impact however we advise that you talk firstly with your Umbrella organisation should you have any queries or questions.
